By participating in our competition, the following general terms and conditions are accepted:

The competition is a limited-term action by Hairdreams Haarhandels GmbH, based in Floraquellweg 9, 8051 Graz (hereinafter “Hairdreams”).

By participating, the participant expressly acknowledges these terms and conditions. Hairdreams reserves the right to terminate the competition at any time without notice and without giving reasons.

Implementation period

The competition starts on 30/06/2024 at 9 am and ends on 01/07/2024 at 4 pm.

Eligibility

People who are at least 18 years of age are eligible to participate in the Hairdreams Lucky Draw.

Employees, authorized representatives, legal successors and representatives of Hairdreams Haarhandels GmbH, involved agencies and further partners and their relatives are not entitled to participate.

Participation

Participation is free of charge and independent of the purchase of goods and services. A person is only allowed to participate once.

If there is reason to suspect that the conditions of participation have been infringed or false, illegible, deceptive or other invalid or unlawful information has been provided or that technical manipulation has been attempted to influence the application, Hairdreams reserves the right to exclude participants from the raffle and from the competition. In the event of exclusion from the competition, the profit may be subsequently denied and reclaimed.

Participation via lottery clubs or automated services is not permitted.

Exclusion of liability

Hairdreams is not liable in any form for direct or indirect damages resulting from participation in the raffle, competition or non-availability of the Internet server except if these are due to gross negligence or intentional action caused by Hairdreams.

Hairdreams is not liable for any data loss, especially in the case of data transmission and other technical defects.

Hairdreams is not liable for the correctness of any information, in particular if it has been altered or distorted by technical errors, transmission losses, intervention by third parties or force majeure. The participant has no right of compensation in any form or other claims against Hairdreams.

Prize win

The following prize will be raffled among all participants of the competition:
$500 discount voucher which can be redeemed when purchasing a Hairdreams starter kit

Determination of the winner

Among all participants, the two winners will be drawn and notified in writing, by telephone or by email. If a winner does not respond within 21 days of notification, the claim to the prize will be forfeited without compensation. There is no obligation to accept the prize. Payment of the prize, e.g. in cash, in kind or transfer to other persons, is not possible.

Use of the Personal Date

The participant of the competition expressly agrees that his personal data will be stored by Hairdreams Haarhandels GmbH in the scope of the participation of this competition and in the scope of consignment of advertising material. The passing on of the personal data to other enterprises, which are not directly linked to the competition, does not take place. This consent may be withdrawn with respect to Hairdreams Haarhandels GmbH, Floraquellweg 9, 8051 Graz, Austria, LD-M@hairdreams.com at any time. Withdrawal shall have no effect on the lawfulness of the processing performed up to that point in time

Use of photographic and/or film material

The participant grants Hairdreams Haarhandels GmbH all rights of use to the posts and/or media (“material”) published by him as follows:

As described above, Hairdreams acquires all rights to published posts and/or media of the participant, regardless of their legal nature under current or future legal situation (according to domestic, foreign and/or international law), in particular all property rights and intellectual property rights. This granting of rights is realised on an exclusive basis.

Consequently Hairdreams has in particular the irrevocable, exclusive, (world-wide) rights of use unlimited with regard to time, subject matter and place, for these services, in particular for complete and/or partial utilisation, publication, duplication, distribution, processing, further development, transmission, immaterial reproduction and any other use that is possible at present or in the future (irrespective of whether already known today), for example on the Internet or in other new media. Hairdreams has in particular also the right to assign these rights wholly or partially to third parties, to grant sub-licenses, rights of use and/or licences for the use of the works, and to exercise these rights themselves or by way of third parties. There is no obligation to use the material for Hairdreams. The creator or the participant does not have to be mentioned by name.

The participant ensures and guarantees Hairdreams that he is the owner of all necessary rights to posts and/or media.

The participant shall indemnify Hairdreams against any claims by third parties arising against Hairdreams from the infringement of third party rights by the announcement/participation (e.g. by comments violating the law or by the illegal use of the uploaded photo).

Legal recourse

There is no recourse to legal action. The claim for the profit cannot be assigned to third parties.

 

Other

In case of individual regulations of these terms of participation being or becoming invalid, this shall not affect the legal validity of the other terms of participation. It is replaced by the regulation most appropriate to the purpose of the ineffective terms.

In the event of legal disputes, Singaporean law shall be decisive. The application of the UN purchase law is excluded.

The court of jurisdiction is the competent court of law at the headquarters of Hairdreams Haarhandels GmbH (Graz/Austria).

The term “participant” and similar terms are to be interpreted as gender-neutral.
